Resident Services and Rewards Terms for Property Managers

The Resident Services and Rewards program is a program where Yardi markets products and services to your residents. When your residents enroll in the Rewards by RentCafe program and sign up for eligible resident services, they will earn points that can be redeemed at thousands of retailers.

Client (“Client” or “you”) has read, understands and agrees to be bound by the Resident Services and Rewards Terms for Property Managers posted at: https://resources.yardi.com/legal/rentcafe/rewards/terms-pm/ (“Terms”), which shall govern Client’s participation in the Resident Services and Rewards program (“Resident Services and Rewards Program”) provided by Yardi Systems, Inc. and its affiliated entities (collectively, “Yardi”).

1. “Resident” means residents and prospective residents at a Client property.

2. Resident Services. Resident Services are available from Yardi, its subsidiaries, and its product and service partners (collectively, “Yardi and Partners” or “Y&P”). You expressly authorize, acknowledge and agree to allow Y&P to contact your Residents on your behalf in order to offer and provide certain products and services (“Resident Services”) directly to your Residents, including by (a) placing and maintaining advertising materials in the RentCafe Online Leasing workflow and Resident Portal, (b) sending text messages (including text messages sent via automatic telephone dialing system), (c) e-mailing (including by displaying your email address or domain as the email sender), (d) sending U.S. mail, and (e) by any other methods that comply with applicable consumer rules and regulations (collectively, “market”). You expressly acknowledge and agree that you shall not interfere with such marketing by Y&P or with the ability of a Resident to receive Resident Services if they choose to do so, and that the marketing, offering, and providing of Resident Services shall not violate any other agreement, promise, or undertaking that you have with any third party. You further acknowledge, agree, and grant Yardi the right to access and use Resident Data (defined as your Residents names, addresses, phone numbers, email addresses, and lease details (which are used to determine if a unit is vacant, occupied, unavailable, to calculate rewards based on the lease amount, and the like)), which Yardi will only use in connection with (i) marketing Resident Services to Residents, (ii) for reasonable business record retention purposes, (iii) to disclose to third parties as required by applicable law, and (iv) to disclose and use to and by Y&P as necessary to provide the Resident Services. However, Yardi shall not share Resident Data with your competitors or use or sell Resident Data to anyone for any other purpose, except that a Resident who chooses to license and use any Resident Services may agree to privacy policies or other applicable terms and conditions applicable to the Resident Services where Residents authorize and consent to the use and sharing of their information in accordance with such policies and terms.

Renter’s Insurance Services. Additional terms of use (the “RI TOU”) apply, are incorporated into these Resident Services and Rewards Terms, and are posted at Renters Insurance Terms of Use.

Obligo Security Deposit Alternative Services.  Additional terms of use (“SDA TOU”) apply, are incorporated into these Resident Services and Rewards Terms, and are posted at https://resources.yardi.com/legal/rentcafe/rewards/obligo/.

3. Rewards by RentCafe Program.

a.     When your Residents enroll in the Rewards by RentCafe program and sign up for eligible Resident Services, they will earn points that can be redeemed at thousands of retailers.

b.     Client has the option to purchase points for the Rewards by RentCafe program and award such points to Client’s Residents at Client’s discretion, which points can be redeemed by Residents at thousands of retailers. Any purchase of such points is not refundable.

4. To the extent that Client has an existing contract with Yardi and/or one of Yardi’s subsidiaries for ResidentShield Insurance or ResidentShield Power, then such contract(s) shall continue in effect notwithstanding this amendment.

5.     Client Representations, Warranties, and Covenants. Client represents, warrants and covenants to each of the following:

a.     Client has full power and authority to enter into and perform its obligations under this Addendum.

b.     Client has obtained any and all required consents from, and provided any and all necessary privacy notices to, Residents to enable Yardi’s marketing and implementation activities contemplated by this Addendum. Notwithstanding anything to the contrary in this Addendum, Client shall permit Residents to report their respective consumer account information to any credit reporting agency.

c.     Yardi may list Client as participating in the Resident Services and Rewards Program on Yardi’s websites and use Client’s logo(s) and marks in Yardi’s marketing and collateral materials.

6. Amendments to the Terms. Yardi reserves the right to add, delete or change the Terms at any time IN ITS SOLE DISCRETION, including but not limited to when such changes are required by Applicable Law or any other legal, regulatory, contractual or other requirement imposed by regulatory authority or any other entity involved in any way, whether directly or indirectly, with the Resident Services and Rewards program.
